- The following
Terms and Conditions apply to all transactions with the
Company “Linguatique Limited”, VAT number: 854 4103 41 unless
variations have been agreed in writing with a Director before a
transaction takes place. The Company does not offer any of
the goods appearing on this website for sale. Instead we
are inviting the Customer to place an offer with us and we
reserve the right to reject any such offer received from
the Customer. If we accept any such offer we will notify
the Customer by email and a legally binding contract will be
formed between us at the time of sending such notification
to. On placing an order the customer will be asked to
acknowledge that the terms and conditions have been read and are
accepted before the transaction can be completed. These
terms and conditions may be amended from time to time and it is
incumbent on the Customer to revisit the Terms and Conditions
every time an order is placed.
- Prices
Prices
are subject to change without prior notice and the valid price
shall be the price published on the date of order. Prices
showing on the website as 0.00 have not yet been fixed.
- Payment for
Account Holders
Except by prior written agreement with a
Director of the Company payment for account holders is due strictly
within 30 days of receipt of invoice. Payments by cheque should be
made payable to Linguatique Limited and sent to:

If Account Holders wish to make payment
by Bank Transfer please contact our Accounts Department for bank
account details.
In the case of overdue invoices the
Company reserves the right to charge interest at a rate of 2%. All
charges incurred by third parties for the recovery of unpaid bills
shall be the responsibility of the Account Holder. The Company
reserves the right to refuse credit and suspend or close an account
at its own discretion without explanation.
- Payment by
Private Customers
The Company regrets that it is unable at
this time to offer credit facilities to non-account holders.
Private customers can pay by postal order or cheque and payment
should be accompanied by a copy of the completed order form
downloaded from the Website. Cheques should be made payable to
Linguatique Limited and sent to the Accounts Department at the
address shown in Section 3. In the case of payment by cheque, goods
will only be dispatched when the cheque has cleared.
- Placing an
order
Customers are invited to place their
order by completing the online order form and submitting it from the
Company website. Customers who prefer to order by post can print a
copy of the order form and complete it. Orders by post should be

The Company regrets that it cannot
accept orders over the telephone unless these are confirmed in

- Carriage
and packaging
All
orders will be subject to a charge of £5 + VAT for carriage and
packaging that will be added to the invoice. The Company
reserves the right to vary this charge without prior notice. In
the event of a modification to this charge Section 3 of the
Terms and Conditions will be amended to show the revised
charge. The date of the order will determine the charge that is
applied.
7.
Delivery
All the
products on this Website are imported from overseas. Whilst
every effort is made to expedite a speedy delivery customers
must appreciate that it is impossible to guarantee a fixed time
for delivery and that a waiting time of four to six weeks is not
unusual. The Company accepts no liability for any loss, damages
or expenses arising from the late delivery of goods due to any
event that is beyond its reasonable control, or by its agents or
its agents carriers due to any cause whatsoever.
8.
Title and
Responsibility
The
title of goods supplied and its ownership shall remain the
property of the Company until full payment has been received for
all the goods supplied. However, responsibility for damage to
or loss of goods will pass to the Customer on delivery of the
goods into the Customers possession, or to the carrier or place
of delivery nominated by the Customer and will remain the
responsibility of the Customer thereafter. The Company must be
notified within 7 working days of the Customer accepting the
goods if, on receipt, they are found to be damaged, incorrect or
incomplete in any way. Failure to notify within this time
period could nullify any claim.
9.
Cancellation and
Refunds
When
goods are ordered in error the Customer may cancel within 7
working days of the date of order and incur no penalties. The
Company reserves the right to levy a £5 cancellation charge
beyond this time period to cover the cost of administration. If
it is only on receipt of the goods that the Customer notifies
the Company of their error or if the Customer refuses to accept
the delivery they will be liable to a 20% handling charge and
the full cost of carriage and packaging.
10.
Return of Goods
All
goods purchased from the Linguatique.com website are protected
by the normal statutory guarantees. In the case of faulty or
defective goods Customers should contact the Customer Service
Department for advice as soon as possible (full details of which
are given on the Contact Page).
If on
receipt of goods the Customer has made an ordering error it may
be possible, after seeking authorisation from the Company, to
return these goods subject to a 20% handling fee. In these
circumstances goods can only be returned if they are resaleable
and all the packaging is intact.
11.
Catalogue Descriptions
Every
effort is made to ensure that illustrations and descriptions in
the catalogue are accurate. Customers however should understand
that colours, designs and product specifications can be modified
by manufacturers and as such cannot be guaranteed. Promotional
literature on the website does not constitute a trade
description.
Each
product on the Website is flagged with a level of language
competence using the terms “Beginner” “Intermediate” and
“Advanced”. These are given as a guide only and the Company
cannot accept responsibility if the Customer does not agree with
the level given to a particular product.
Customers should also be aware that toy and game instructions
are written in French and require translation by a fluent French

12.
Child Safety
Unless
otherwise stated in the product description Customers should
assume that these products are not suitable for children under
the age of 3 due to small parts.

Use of this Website
In consideration of agreeing to your use
of this website, you acknowledge that the ownership of in any
intellectual property rights (including, for the avoidance of doubt,
copyright) in this website belongs to us. Accordingly, any part of
this website (or its source HTML code) may not be used, transferred,
copied or reproduced in whole or in part in any manner other than
for the purposes of utilising this website meaning that you may only
display it on your computer screen and print it out on your printer
for the sole purpose of viewing its content.
- Law
This agreement is and shall be governed by and
construed in accordance with the laws of England. Any disputes which
may arise between the parties concerning this arrangement shall be
determined by the English courts and the parties hereby submit to
the exclusive jurisdiction of the English courts for such purpose.
